Project Description:
GPTech supports MCC in the drafting of a public-private partnership (PPP) law for The Gambia, which has been under discussion since 2018; its enactment has been delayed due to external factors, such as the COVID-19 pandemic. The PPP law review covers the proposed scope and coverage of the law and institutional roles, rights, responsibilities, processes, and remedies in accordance with international good practice. This includes affordability, value for money, risk allocation, public interest, fiscal prudence, competitive pressure, transparency and accountability, protection of adequate investor rights and remedies against political risk/materially adverse government action, transparent tariff adjustments, independent contract supervision, lender rights and security, and expeditious and independent dispute resolution.
Goals & Achievements:
Draft the PPP law for the Government of The Gambia.
Provide input on the development of the terms of reference for technical assistance contractors for The Gambia.
Advise on implementing entity agreements and oversite of PPP.
